Terms of Service

These Terms of Service (“Terms”) govern your access to and use of VybeSec, Inc. (“VybeSec”) services, including our website, SDK, API, and dashboard (collectively, the “Service”). By using the Service, you agree to these Terms.

1. Eligibility

You must be at least 16 years old to use the Service. By using the Service, you represent that you have the authority to enter into these Terms on behalf of yourself or your organization.

2. Your account

You are responsible for keeping your account credentials secure. Notify us immediately at security@vybesec.com if you suspect unauthorized access. VybeSec is not liable for losses arising from failure to keep your account secure.

You may not share your account with others or create multiple free accounts to circumvent plan limits.

3. Acceptable use

You agree not to:

• Use the Service to monitor applications you don't own or have permission to monitor
• Attempt to reverse-engineer or extract source code from the Service
• Use the Service to store or transmit malicious code
• Attempt to gain unauthorized access to any part of the Service or its infrastructure
• Use the Service in any way that violates applicable laws or regulations
• Resell or white-label the Service without written authorization

4. SDK and data

By installing the VybeSec SDK in your application, you grant VybeSec permission to receive, process, and store error event data as described in our Privacy Policy. You represent that you have obtained all necessary consents from your end users to transmit this data.

You are solely responsible for ensuring data sent through the SDK complies with applicable privacy laws.

5. Payment and plans

Paid plans are billed monthly or annually in advance via Stripe. Prices are in USD and exclude taxes.

You may cancel at any time. Cancellation takes effect at the end of the current billing period. We don't provide refunds for unused portions of a billing period, except where required by law.

We may change our pricing with 30 days' notice. Continued use after a price change constitutes acceptance of the new pricing.

6. Service availability

We target 99.9% uptime on the error capture endpoint and 99.5% on the dashboard. We are not liable for downtime caused by factors outside our reasonable control.

7. Intellectual property

VybeSec retains all rights to the Service, including software, design, and branding. You retain ownership of all data you submit. By using the Service, you grant VybeSec a limited license to process that data to provide the Service.

8. Limitation of liability

To the maximum extent permitted by law, VybeSec's total liability to you shall not exceed the amount you paid to VybeSec in the 12 months before the claim arose, or $100 USD if you paid nothing.

VybeSec is not liable for any indirect, incidental, special, consequential, or punitive damages.

9. Governing law

These Terms are governed by the laws of the State of California, USA. Disputes shall be resolved in the courts of San Francisco County, California.

10. Changes to Terms

We may update these Terms from time to time. We'll notify you of material changes via email or a dashboard notice. Continued use after the effective date of changes constitutes acceptance.
